If you are one of two or more co-owners of a property in Spain, you need to know that you can put an end to this situation and that the other co-owners cannot prevent you from selling your part of the property.
If you want to sell your part of the property but you cannot reach an agreement with the other co-owners you can start a proceedings in which the judge will force the other party to sell and then each co-owner will receive the benefits from the sale according to his share of the property.
The other co-owner can only oppose this proceedings if you all agreed not to sell the property during a certain time, on the contrary this proceedings leaves the co-owners without the possibility to oppose the sale.
If there are any debts between the co-owner for the expenses of the property or any other kind of debts, this can be claimed in the same proceedings. Once the property has been sold and the money has been paid to each co-owner, if any of them owe you money they should pay you and settle their debt to you this way.
